1. Definitions
In these Terms, “TravelBoost”, “we”,“us”, and “our” refer to Travelboost Inc., a corporation incorporated in Delaware, United States, with its registered office at 251 Little Falls Drive, Wilmington, DE 19808, United States.
“You”, “Customer”, or “Agency” means the organisation or individual accessing the Service, whether under a paid plan or a free trial. “Service” or“Platform” means the TravelBoost web application, mobile applications, APIs, documentation, and any related tools we make available.
2. Account creation
To use the Service you must create an account. You must be at least 18 years old, provide accurate information, keep your credentials secure, and immediately notify us of any unauthorised access at [email protected]. You are responsible for all activity that occurs under your account.
3. Subscription plans and billing
The Service is offered on a subscription basis. Plans, features, and pricing are described on travelboost.app/pricing and may change with notice. Unless stated otherwise:
- Subscriptions renew automatically at the end of each billing cycle (monthly or annually).
- Fees are exclusive of taxes; you are responsible for VAT, sales tax, or equivalents in your jurisdiction.
- Failed payments may result in service suspension after a 7-day grace period.
- Currency conversion, if applicable, uses the exchange rate at the time of billing.
4. Free trial
We offer a 14-day free trial. No credit card is required to start. During the trial you have access to the full feature set of the plan you selected. When the trial ends, you may add a payment method to continue — otherwise the account transitions to a limited read-only mode for 30 days, after which data is deleted (see Refund & Cancellation).
5. Your data
You retain all rights to the data you upload to the Service (“Customer Data”), including leads, customers, bookings, invoices, and files. We process Customer Data only to provide the Service and only as described in our Privacy Policy and, where applicable, in the Data Processing Agreement.
You are responsible for the accuracy, quality, and legality of Customer Data and for obtaining the necessary consents from your own customers, suppliers, and staff before uploading their personal data.
6. Acceptable use
Your use of the Service must comply with our Acceptable Use Policy. In particular, you may not use the Service for illegal activity, spam, malware distribution, unauthorised access, or in a way that harms other users or degrades service performance.
7. Intellectual property
The Service — including its software, design, trademarks, and documentation — is and remains the exclusive property of Travelboost Inc. or its licensors. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service in accordance with these Terms. You may not:
- Copy, modify, or create derivative works of the Service.
- Reverse engineer, decompile, or attempt to extract the source code.
- Resell or sub-licence the Service without our prior written consent.
- Remove or alter proprietary notices or trademarks.
8. Confidentiality
Each party will treat non-public information disclosed by the other as confidential and use it only for the purpose of performing under these Terms. This does not apply to information that becomes public through no fault of the receiving party, was already known, or must be disclosed by law.
9. Warranties and disclaimers
We warrant that the Service will perform materially as described in our documentation. Beyond this, and to the maximum extent permitted by law, the Service is provided “as is” without warranties of any kind — merchantability, fitness for a particular purpose, non-infringement, uninterrupted access, or accuracy of Customer Data are all expressly disclaimed.
10. Limitation of liability
To the maximum extent permitted by law, neither party will be liable to the other for indirect, consequential, incidental, special, or punitive damages, including lost profits, revenue, data, or business opportunities.
Our total aggregate liability under these Terms will not exceed the fees paid by you to us in the twelve months preceding the event giving rise to the claim.
11. Indemnification
You will indemnify and hold harmless Travelboost Inc., its officers, directors, employees, and affiliates from any third-party claim arising from your Customer Data, your violation of these Terms, or your violation of any law or third-party right.
12. Termination
You may terminate your account at any time from the settings screen. We may suspend or terminate your account with notice for material breach of these Terms, or immediately if required by law or in cases of abuse, fraud, or security threats. On termination:
- Access to the Service is disabled.
- You may export your Customer Data for 30 days after termination.
- After 30 days, Customer Data is permanently deleted from active systems (backups purge within 90 days).
- Unpaid fees remain due; already-paid subscription fees are not refundable except as described in the Refund policy.
13. Modifications to the Service and to these Terms
We may modify the Service at any time to add, remove, or change features. If a change materially reduces functionality, we will notify you in advance. We may modify these Terms with at least 30 days’ notice via email or in-app notice. Continued use after the effective date constitutes acceptance.
14. Governing law and jurisdiction
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles. The exclusive jurisdiction and venue for any dispute is the state and federal courts located in Wilmington, Delaware, and both parties consent to personal jurisdiction there.
15. Miscellaneous
- Entire agreement: these Terms, together with our Privacy Policy, DPA, and any order form, constitute the entire agreement between us.
- Severability: if any provision is held unenforceable, the remainder continues in force.
- No waiver: failure to enforce any right is not a waiver of that right.
- Assignment: you may not assign these Terms without our written consent; we may assign in connection with a merger or sale of substantially all our assets.
- Notices: to us via [email protected]; to you via the email address on your account.
